Applicable Legal Bases

Below, we provide information about the legal bases of the General Data Protection Regulation (GDPR) on which we process personal data. Please note that, in addition to the provisions of the GDPR, national data protection regulations in your or our country of residence or registered office may apply.

  • Performance of a contract and pre-contractual enquiries (Art. 6(1)(b) GDPR) – Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  • Legal obligation (Art. 6(1)(c) GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • Legitimate interests (Art. 6(1)(f) GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

National data protection regulations in Germany: In addition to the data protection provisions of the General Data Protection Regulation, national data protection regulations apply in Germany. These include, in particular, the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG). The BDSG contains, in particular, specific provisions concerning the right of access, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes, data transfers and automated decision-making in individual cases, including profiling. It also regulates data processing for employment purposes (§ 26 BDSG), in particular with regard to the establishment, performance or termination of employment relationships and employee consent. In addition, the data protection laws of the individual German federal states may apply.

Use of Cookies

Cookies are text files containing data from websites or domains visited and are stored by a browser on the user’s computer. A cookie is primarily used to store information about a user during or after their visit to an Online Service. The stored information may include, for example, language settings on a website, login status, a shopping cart or the point at which a video was viewed. The term “cookies” also includes other technologies that perform the same functions as cookies (e.g. where user information is stored using pseudonymous online identifiers, also referred to as “user IDs”).

The following types and functions of cookies are distinguished:

  • Temporary cookies (also known as session cookies): Temporary cookies are deleted at the latest after a user leaves an Online Service and closes their browser.
  • Permanent cookies: Permanent cookies remain stored even after the browser has been closed. For example, the login status can be saved or preferred content can be displayed immediately when the user revisits a website. Likewise, users’ interests used for audience measurement or marketing purposes may be stored in such a cookie.
  • First-party cookies: First-party cookies are set by us.
  • Third-party cookies: Third-party cookies are mainly used by advertisers (so-called third parties) to process user information.
  • Necessary (also: essential or strictly necessary) cookies: Cookies may be strictly necessary for the operation of a website (e.g. to store logins or other user input or for security purposes).
  • Statistics, marketing and personalisation cookies: Cookies are also generally used for audience measurement and where a user’s interests or behaviour (e.g. viewing certain content, using functions, etc.) on individual websites are stored in a user profile. Such profiles are used, for example, to display content to users that may correspond to their potential interests. This process is also referred to as “tracking”, i.e. tracking the potential interests of users. Where we use cookies or tracking technologies, we will inform you separately in our Privacy Policy or when obtaining consent.

Information on legal bases: Where consent is required for the storage of information on the user’s terminal device or for access to information already stored there, this is carried out on the basis of Section 25(1) TDDDG. Subsequent processing of personal data is carried out on the basis of consent pursuant to Art. 6(1)(a) GDPR. Consent is not required where the storage of information or access to information already stored is strictly necessary pursuant to Section 25(2) TDDDG in order to provide a digital service expressly requested by the user. Further processing of personal data in such cases is carried out on the basis of the applicable provisions of the GDPR.

General information on withdrawal and objection (opt-out): You may withdraw consent you have given at any time with effect for the future. Where processing is based on legitimate interests, you may object to such processing in accordance with the statutory requirements. In addition, you can delete or restrict cookies in your browser settings. This may limit the functionality of the Online Service.

Processing of cookie data on the basis of consent: Where consent is required for the use of cookies or comparable technologies, these will only be used after consent has been given. Consent may be withdrawn at any time with effect for the future. Strictly necessary cookies and comparable technologies may be used without consent where the statutory requirements for doing so are met.

  • Types of data processed: Usage data (e.g. websites visited, interest in content, access times), meta/communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Legal bases: Consent (Art. 6(1)(a) GDPR), legitimate interests (Art. 6(1)(f) GDPR).

Polylang
For the multilingual functionality of our website, we use Polylang, a service provided by WP-Syntex, France. Polylang uses the pll_language cookie to store the language selected or most recently used by the user and to make it available again on subsequent visits. The standard storage period is one year. The cookie is used exclusively to control the language settings of our website.

Technically necessary cookies and cookie settings used on this website:

Security Measures

In accordance with the statutory requirements and taking into account the state of the art, implementation costs and the nature, scope, circumstances and purposes of processing as well as the varying likelihood and severity of risks to the rights and freedoms of natural persons, we take appropriate technical and organisational measures to ensure a level of security appropriate to the risk.

The measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as access relating to the data, input, disclosure, safeguarding availability and separation. Furthermore, we have established procedures to ensure the exercise of data subject rights, the deletion of data and responses to threats to data security. We also take the protection of personal data into account when developing or selecting hardware, software and procedures in accordance with the principles of data protection by design and by default.

SSL encryption (https): To protect data transmitted via our Online Service, we use SSL encryption. You can recognise encrypted connections of this kind by the prefix https:// in your browser’s address bar.

Transmission and Disclosure of Personal Data

As part of our processing of personal data, data may be transmitted to or disclosed to other bodies, companies, legally independent organisational units or persons. Recipients of such data may include, for example, payment institutions in connection with payment transactions, service providers commissioned with IT tasks, or providers of services and content integrated into a website. In such cases, we comply with the statutory requirements and, in particular, conclude appropriate contracts or agreements with the recipients of your data to protect your data.

Data Processing in Third Countries

Where we process personal data in third countries outside the EU or the EEA, or have such data processed by service providers, this is done only in accordance with the statutory requirements, in particular on the basis of an adequacy decision by the European Commission or appropriate safeguards pursuant to Articles 44 et seq. GDPR, such as Standard Contractual Clauses.

Commercial and Business Services

We process data relating to our contractual and business partners, e.g. customers and prospective customers (collectively referred to as “contractual partners”), within the framework of contractual and comparable legal relationships and associated measures, as well as in the context of communication with contractual partners (or prior to entering into a contract), e.g. in order to respond to enquiries.

We process this data in order to fulfil our contractual obligations, safeguard our rights and perform administrative tasks associated with this information as well as for business organisation purposes. Within the scope of applicable law, we only disclose the data of contractual partners to third parties insofar as this is necessary for the aforementioned purposes or for compliance with legal obligations, or where this is done with the consent of the contractual partners (e.g. to telecommunications, transport and other auxiliary service providers involved, as well as subcontractors, banks, tax and legal advisers, payment service providers or tax authorities). Contractual partners will be informed about other forms of processing, e.g. for marketing purposes, within the framework of this Privacy Policy.

We inform contractual partners which data is required for the aforementioned purposes before or during data collection, e.g. in online forms, by means of special markings (e.g. colours) or symbols (e.g. asterisks or similar), or personally.

We delete personal data as soon as it is no longer required for contractual purposes and there are no statutory retention obligations preventing deletion. Where statutory obligations apply, we retain the data for the respective required period and delete it afterwards.

Where we use third-party providers or platforms to provide our services, the terms and conditions and privacy policies of the respective third-party providers or platforms apply in the relationship between users and those providers.

Contact

When contacting us (e.g. via contact form, email, telephone or social media), the information provided by the person making the enquiry is processed insofar as this is necessary to respond to the enquiry and any requested measures.

Responses to contact enquiries within the framework of contractual or pre-contractual relationships are processed in order to fulfil our contractual obligations or respond to (pre-)contractual enquiries and, otherwise, on the basis of our legitimate interests in responding to enquiries.

  • Types of data processed: Master data (e.g. names, addresses), contact data (e.g. email addresses, telephone numbers), content data (e.g. text entries, photographs, videos).
  • Data subjects: Communication partners.
  • Purposes of processing: Contact requests and communication.
  • Legal bases: Performance of a contract and pre-contractual enquiries (Art. 6(1)(b) GDPR), legitimate interests (Art. 6(1)(f) GDPR).

Provision of the Online Service and Web Hosting

In order to provide our Online Service securely and efficiently, we use the services of one or more web hosting providers from whose servers (or servers managed by them) the Online Service can be accessed. For these purposes, we may use infrastructure and platform services, computing capacity, storage space and database services as well as security and technical maintenance services.

Hosting provider
Our Online Service and our email communications are hosted by netcup GmbH, Daimlerstraße 25, 76185 Karlsruhe, Germany.

The data processed in connection with the provision of hosting services may include all information relating to users of our Online Service that arises during use and communication. This regularly includes the IP address, which is necessary in order to deliver the content of Online Services to browsers, as well as all entries made within our Online Service or on websites.

Email transmission and hosting: The web hosting services we use also include the sending, receiving and storage of emails. For these purposes, the addresses of recipients and senders as well as other information relating to email transmission (e.g. the providers involved) and the content of the respective emails are processed. The aforementioned data may also be processed for the purpose of detecting spam. Please note that emails on the internet are generally not sent using end-to-end encryption. As a rule, emails are encrypted during transmission, but unless an end-to-end encryption method is used, they are not encrypted on the servers from which they are sent and received. We therefore cannot assume responsibility for the transmission route of emails between the sender and receipt on our server.

Collection of access data and log files: We ourselves (or our web hosting provider) collect data relating to each access to the server (so-called server log files). Server log files may include the address and name of the websites and files accessed, the date and time of access, the amount of data transferred, notification of successful retrieval, browser type and version, the user’s operating system, referrer URL (the previously visited page) and, as a rule, IP addresses and the requesting provider.

Server log files may be used for security purposes, e.g. to prevent server overload (particularly in the event of abusive attacks, so-called DDoS attacks), and to ensure server utilisation and stability.

  • Types of data processed: Content data (e.g. text entries, photographs, videos), usage data (e.g. websites visited, interest in content, access times), meta/communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).

Social Media Presence

We maintain online presences within social networks in order to communicate with users who are active there or to provide information about us.

On our website, Facebook and Instagram are accessible exclusively via external links. A connection to these providers is only established when the respective link is accessed.

We would like to point out that when social networks are used, user data may also be processed outside the European Union or the European Economic Area. Where personal data is transferred to third countries, such transfer takes place in accordance with the applicable data protection requirements.

Furthermore, user data within social networks is generally processed for market research and advertising purposes. For example, user profiles may be created on the basis of usage behaviour and the resulting interests of users. These user profiles may in turn be used, for example, to display advertisements within and outside the networks that are presumed to correspond to users’ interests. For these purposes, cookies are generally stored on users’ computers in which their usage behaviour and interests are stored. In addition, data may be stored in user profiles independently of the devices used by users, particularly where users are members of the respective platforms and are logged in to them.

For a detailed description of the respective forms of processing and the options for objection (opt-out), please refer to the privacy policies and information provided by the operators of the respective networks.

In the case of requests for information and the exercise of data subject rights, we would also like to point out that these can be asserted most effectively with the respective providers. Only the providers have access to users’ data and can take appropriate measures and provide information directly. If you nevertheless require assistance, you may contact us.

  • Types of data processed: Master data (e.g. names, addresses), contact data (e.g. email addresses, telephone numbers), content data (e.g. text entries, photographs, videos), usage data (e.g. websites visited, interest in content, access times), meta/communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Contact requests and communication, audience measurement (e.g. access statistics, recognition of returning visitors).
  • Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).

Services and service providers used:

Deletion of Data

The data processed by us will be deleted in accordance with the statutory requirements as soon as consent permitting its processing is withdrawn or other permissions cease to apply (e.g. if the purpose for processing this data no longer applies or the data is no longer required for that purpose).

Where data is not deleted because it is required for other legally permissible purposes, its processing will be restricted to those purposes. This means that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons or whose storage is necessary for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.

Further information regarding the deletion of personal data may also be provided within the individual privacy notices contained in this Privacy Policy.

Changes and Updates to the Privacy Policy

We ask you to regularly review the content of our Privacy Policy. We will amend the Privacy Policy whenever changes to the data processing activities carried out by us make this necessary. We will inform you if the changes require action on your part (e.g. consent) or any other individual notification.

Where we provide addresses and contact information for companies and organisations in this Privacy Policy, please note that addresses may change over time and we therefore ask you to verify the information before making contact.

Rights of Data Subjects

As a data subject, you have various rights under the GDPR, arising in particular from Articles 15 to 18 and 21 GDPR:

  • Right to object: You have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you which is based on Art. 6(1)(e) or (f) GDPR; this also applies to profiling based on those provisions. Where personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
  • Right to withdraw consent: You have the right to withdraw consent you have given at any time.
  • Right of access: You have the right to request confirmation as to whether relevant data is being processed and to obtain information about such data as well as further information and a copy of the data in accordance with the statutory requirements.
  • Right to rectification: In accordance with the statutory requirements, you have the right to request that data concerning you be completed or that inaccurate data concerning you be corrected.
  • Right to erasure and restriction of processing: In accordance with the statutory requirements, you have the right to request that data concerning you be deleted without undue delay or, alternatively, to request restriction of the processing of the data.
  • Right to data portability: You have the right to receive data concerning you that you have provided to us in a structured, commonly used and machine-readable format in accordance with the statutory requirements, or to request its transmission to another controller.
  • Right to lodge a complaint with a supervisory authority: In accordance with the statutory requirements, you also have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data concerning you infringes the GDPR.

Definitions

This section provides an overview of the terminology used in this Privacy Policy. Many of the terms are taken from the law and are defined primarily in Art. 4 GDPR. The statutory definitions are binding. The following explanations are primarily intended to aid understanding. The terms are listed alphabetically.

  • Personal data: “Personal data” means any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. a cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Audience measurement: Audience measurement (also referred to as web analytics) is used to evaluate visitor traffic to an Online Service and may include visitors’ behaviour or interests in certain information, such as website content. Audience analysis can help website operators identify, for example, when visitors access their website and which content they are interested in. This enables them, for example, to better adapt website content to the needs of visitors. For audience analysis purposes, pseudonymous cookies and web beacons are frequently used to recognise returning visitors and thereby obtain more accurate analyses of the use of an Online Service.
  • Controller: “Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
  • Processing: “Processing” means any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers practically any handling of data, including collection, evaluation, storage, transmission or deletion.
